The Role of the Friend of the Court
What does the Friend of the Court do when someone does not follow the parenting time order?

A custody or parenting time order violation is an individual's act or failure to act that interferes with a parent's right to interact with his or her child in the time, place, and manner established in the court order that governs custody or parenting time between the parent and child.

You may submit a written complaint to the friend of the court with the exact dates that you were denied parenting time. The friend of the court must send a copy of that complaint to the other parent. The notice:

  • Informs that parent about the complaint.

  • Explains that either parent can ask the court to change the order.

  • Informs the parents that they can mediate the dispute.

The friend of the court can take five types of actions to resolve the dispute:

  1. call a joint meeting.

  2. apply makeup parenting time.

  3. start civil contempt proceedings.

  4. schedule mediation.

  5. File a motion and complete a recommendation for modification of the parenting time order. If neither parent objects to the recommendation within 21 days, it will become a court order. If an objection is filed, a hearing will be held.
